Nashua Man Arrested After DWI Accident

Hudson law enforcement say that a Nashua, New Hampshire man has been arrested for drunk driving charges after he rear-ended another vehicle at a high rate of speed. Police were called to Lowell Road, in Hudson, around 5:30 p.m. in response to a two-car accident. A 2018 Toyota Camry rear-ended a 2018 Subaru Impreza as it was traveling as it was heading north on Lowell Road at a high rate of speed.

Both the driver and the passenger in the Subaru were transported to St. Joseph’s Hospital to treat minor injuries. The driver of the Toyota was arrested at the scene for driving while intoxicated.

DRIVING WHILE INTOXICATED IN NEW HAMPSHIRE

A person is guilty of driving while intoxicated in New Hampshire “while such person is under the influence of:

  • intoxicating liquor; or
  • any controlled drug, prescription drug, over-the-counter drug; or any other chemical substance, natural or synthetic, which impairs a person’s ability to drive or
  • any combination of intoxicating liquor and controlled drugs, prescription drugs, over-the-counter drugs, or
  • any other chemical substances, natural or synthetic, which impair a person’s ability to drive;

OR

While such person has an alcohol concentration of 0.08 or more or in the case of a person under the age of 21, 0.02 or more.”

Aggravated DWI

As it pertains to the scenario above, there was a car accident involving injury to others. If an accident occurs while a person is driving under the influence the charge has the potential to be elevated to “aggravated assault.” Aggravated assault occurs in New Hampshire, when an individual meets the threshold of the definition of Driving Under the Influence AND:

  • “Drives or operates at a speed more than 30 miles per hour in excess of the prima facie limit;
  • Causes a motor vehicle, boating, or OHRV collision resulting in serious bodily injury to the person or another;
  • Attempts to elude pursuit by a law enforcement officer by increasing speed, extinguishing headlamps, or abandoning a vehicle, boat, or OHRV while being pursued; or
  • Carries as a passenger a person under the age of 16.”

In addition, if an individual has a blood alcohol concentration and meets all of the aggravated DWI threshold factors above while also having an alcohol concentration of 0.08 or more they may be found guilty of aggravated DWI. Further, aperson may also be guilty of aggravated assault if they are found to have a blood alcohol concentration of 0.16 or more without having to meet any of the threshold factors.
