In New Hampshire, commercial drivers are held to a higher standard than individuals with other driver’s license classifications.
PUNISHMENTS FOR DWI WITH COMMERCIAL DRIVER’S LICENSE
In New Hampshire, a commercial driver’s license can be suspended for one year if any of the following events takes place:
- The driver receives an administrative license suspense because they refused a breath test while operating any personal or commercial vehicle.
- The driver receives an administrative license suspension for testing at or over 0.08 while driving any motor vehicle – whether personal or commercial.
- The driver receives an administrative license suspension for testing at or over 0.04 while driving a commercial vehicle.
- The driver is convicted of a DWI by a New Hampshire court. Or,
- The driver is convicted for “Conduct after an Accident” by a New Hampshire court. I.e., the driver left the scene or failed to report an accident that occurred in their personal or commercial vehicle.
Additionally, an individual can have their commercial driver’s license revoked for life if they are now facing a DWI in New Hampshire, a DWI-related administrative suspension of their license, or are facing a conviction for “Conduct after an Accident,” and have already experienced one of the events listed above.
Other punishments may include a 60-day suspension of a commercial driver’s license if the driver has had two serious traffic violations in a three-year period or a 120-day suspension if they’ve received three serious traffic violations in a three-year period while driving a commercial vehicle.
